Privacy Policy

Effective Date: MARCH 20, 2017

ClubUp, LLC (“ClubUp”, “us”, “we”, or “our”) operates the ClubUp mobile application for caddies (the “App”) and clubup.us website for golfers (“Site”), which together provide a system by which caddies and golfers are referred to one another and golfers can engage the caddie’s services at a mutually agreed date and time at a mutually agreed golf course. ClubUp also collects golf round data from its golfers and aggregates the data to analyze trends across golfers and courses played. These services are collectively referred to as the “Services” in this Privacy Policy.

This Privacy Policy informs you of ClubUp’s collection, use and disclosure of personal information when you use the Services. Your use of the App or the Site reflects your acceptance of this Privacy Policy. If you disagree with any portion of this Privacy Policy, your sole remedy is to immediately discontinue using the App or the Site.

  1. Information Collection and Use
We collect and use your personal information for a variety of business purposes, including to respond to your requests (for example, to set up an account), to respond to your inquiries, to provide the Services that you request, to communicate with you about our Services, Site and App, to provide you with information about our Services, Site and App, and to do all things necessary to administer our Services, Site and App and to manage, protect and improve them. By using the App or Site, you agree to the collection and use of information in accordance with this Privacy Policy.

“Personal information” is data that can be used to uniquely identify or contact an individual. There are a few ways in which you may explicitly and intentionally provide us with, and consent to our collection of, certain personal information. The App and the Site provide you with the opportunity to create a user account and to contact us to request Services or information. In order to fulfill your request, we collect your name, phone number, email and/or physical address. Caddies provide their address in the App in order to use the App, as requests to assist golfers are filtered by location. Caddies can select from caddying opportunities as available in their vicinity. By initiating any activity or transaction with us that uses financial information, you consent to providing your financial information to our service providers processing the transaction to the extent required to provide the payment services to you. Golfers pay by credit or debit card through the Stripe payment card processing platform. Payments due to caddies are routed to caddies’ designated bank accounts by ClubUp using the Stripe service, so caddies store payment account details with Stripe and not ClubUp. You may wish to consult Stripe’s separate privacy policy available at www.stripe.com prior to using ClubUp’s Services. Stripe is not affiliated with ClubUp.

ClubUp also collects golfers’ stat card data as logged by individual caddies, and reports performance information to the individual golfer regarding their individual performance and on an aggregated basis across golfers and golf courses. The aggregated information is not intended to identify individual golfers or caddies.

  2. App Log Data
When you interact with our App, we as well as our service providers, may use assorted technologies that automatically or passively collect information about how the App is accessed and used. For example, when you access the Services by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use and other statistics (“Log Data”). Log Data is generally non-identifying, but if we associate it with you as an identifiable person, we will treat it as personal information under this Privacy Policy.

Please see the section below called Location Information regarding use of your location information and your options.

  3. Location Information
Many features of our Services and App rely upon device-based location information. To provide such features, we collect, use, transmit, process and maintain data on the geographic location of your mobile device from which the App is accessed. We may use and store information about your location depending on the permissions you have set on your device. We use this information to provide features of our Service, to improve and customize our Service. You can enable or disable location services when you use our App or Services at any time, through your mobile device settings. Please be aware, however, that if you disable location services, certain features of our Services and App may not work as intended.
  4. Site Traffic Data; Do Not Track Requests; Third Party Tracking
When you visit or interact with the Site, we, as well as our service providers and any third-party advertisers, may use assorted technologies that automatically or passively collect information (traffic data) about how the Site is accessed and used, such as Google Analytics. This information helps us improve our Site and Services. Traffic data is generally non-identifying, but if we associate it with you as an identifiable person, we will treat it as personal information.

Unless your browser settings are configured to make your online activities and publicly available information about your online activities through the Site (such as traffic data described above) invisible to usage analytics tools, we do not presently have the capability to omit you from usage analytics run on the Site to the extent your browser only sends us a “do not track” message and does not otherwise screen you from tracking without any action on our part.

Third parties, other than our vendors (such as our website analytics provider), do not have authorization from us to track which websites you visited prior and after visiting our Site. That said, we cannot control all third party tracking and there may be some third party tracking over time and across third-party websites that occurs without our knowledge or consent.
